Privacy and media law: Switzerland

As of 2026-10-05.

Medical confidentiality

Doctors, psychologists, nurses, therapists and their assistants are bound by professional secrecy (Art. 321 Criminal Code). Disclosure is punishable, on the patient's complaint, by up to three years' custodial sentence or a monetary penalty, and the duty outlasts the job. Exceptions: patient consent, written release by the supervisory authority, or a legal duty to report [1].

Health data

The revised Federal Act on Data Protection has applied since 1 September 2023 [2]. Health data counts as sensitive personal data [3]. Wilful breaches can bring fines of up to CHF 250,000 for the responsible individual [2].

Photographs

The right to one's own image is a personality right under Art. 28 of the Civil Code. Publishing a recognisable photo of someone in focus needs consent unless an overriding interest justifies it. Incidental passers-by in public usually cannot object; public figures must tolerate more than private persons [4][5][8]. Recording private matters that are not freely observable without consent is a crime (Art. 179quater Criminal Code), as is passing such images on [1].

Stopping or answering a story

A court can block publication by periodical media in advance only if the violation causes or may cause a serious disadvantage, is obviously unjustified and the measure is proportionate. Since 1 January 2025 a "serious" rather than "particularly serious" disadvantage suffices [6][7]. Afterwards, a person can claim damages and satisfaction (Art. 28a Civil Code) and demand a counter-statement to factual claims in periodical media (Art. 28g to 28l) [4][5].

What this means in practice

Swiss law offers strong confidentiality and real remedies, but most act after the harm is done; no law can guarantee that a photo or leak never happens. The clinic's setup (one client per residence, private arrival, staff discipline) matters as much as the statute.
