Privacy and media law: Thailand

As of 2026-10-05.

Medical confidentiality

National Health Act B.E. 2550 Section 7 bars anyone from disclosing personal health information to the patient's harm without consent or a legal duty: up to six months in prison and/or 10,000 baht (Section 49) [1]. Criminal Code Section 323 adds up to six months and/or a fine for doctors, nurses, pharmacists and assistants who harmfully disclose a patient's secret [2].

Health-data protection

The Personal Data Protection Act B.E. 2562 applies in full since 1 June 2022 [3][4]. Health data is sensitive: collecting it needs explicit consent (Section 26). Sanctions include administrative fines up to 5 million baht, up to one year in prison and damages up to twice the actual loss [3]. The Personal Data Protection Committee enforces it; its first fine, 7 million baht, came in 2024 [5].

Photographs

Thailand has no dedicated image right [6]. Photos of identifiable people are personal data, but the PDPA excludes purely personal use and ethical or public-interest media work (Section 4) [3]. Unauthorised use of an image can be a wrongful act under Civil and Commercial Code Section 420, mainly where loss is shown [6]. Posting an edited image online that harms someone's reputation risks up to three years in prison (Computer Crime Act, Section 16) [7].

Press and defamation

Defamation is a crime, punishable by up to two years and 200,000 baht when published (Sections 326 to 328). Truth is no defence for private matters of no public benefit (Section 330) [2]. Any injured person, client or clinic, may complain. RSF ranks Thailand 92nd of 180 (2026) [8].

What this means in practice

These remedies mostly act after a disclosure, not before, and nothing guarantees privacy. The clinic's setup (one client per residence, private arrival) matters as much as the law.
